Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Bimmy (getbimmy.com), provided by Drumtix Ltd (“Drumtix,” “we,” “us”), a company registered in England and Wales (company number 17267084, registered office at Suite Ra01, 195-197 Wood Street, London, England, E17 3NU). By creating an account or otherwise using Bimmy, you agree to these Terms. If you're accepting on behalf of an organization, you confirm you have the authority to bind that organization.

Eligibility and your account

You must be at least 18 years old to use Bimmy. You're responsible for the content you create, schedule, and publish through Bimmy, for keeping your login credentials secure, and — if you administer an organization — for the actions of the members you invite.

Subscriptions and billing

Some features require a paid subscription. Subscriptions are billed through Stripe and renew automatically until cancelled. Upgrades take effect immediately and are billed pro-rata; downgrades and cancellations take effect at the end of your current billing period. Fees are non-refundable except where required by law. We may change our pricing on advance notice; continued use after a price change takes effect constitutes acceptance of it.

Your content

You own the content you create and upload to Bimmy. You grant us a limited license to host, process, and transmit that content solely to provide the service, including publishing it to the platforms you direct us to. You must have the rights to any content you upload and the authority to connect and publish through any social media account you link to Bimmy.

Connected platforms

Bimmy publishes to third-party platforms — Instagram, Facebook, TikTok, and YouTube — on your behalf, using authorization you explicitly grant through each platform's own login flow. You agree to comply with each connected platform's own terms, including Meta's Platform Terms and Developer Policies, TikTok's Developer Terms, and YouTube's API Services Terms of Service. You can disconnect a platform at any time from your account settings, which immediately revokes Bimmy's access to it. Drumtix isn't responsible for the availability, policies, or content-moderation decisions of those third-party platforms.

Acceptable use

You agree not to use Bimmy to publish unlawful content, infringe on others' rights, violate the terms of service of any connected platform, attempt to abuse, reverse-engineer, or overload the service, or resell access to Bimmy without our consent.

Intellectual property

Bimmy's software, design, and branding are owned by Drumtix. Nothing in these Terms transfers any of that ownership to you.

Disclaimers

Bimmy is provided “as is” and “as available,” without warranties of any kind. We don't guarantee uninterrupted or error-free operation, and since publishing depends on third-party platform APIs outside our control, we can't guarantee that any given post will publish successfully.

Limitation of liability

To the maximum extent permitted by law, Drumtix isn't liable for any indirect, incidental, or consequential damages arising from your use of Bimmy, and our total liability for any claim is capped at the amount you paid us in the 12 months before the claim arose.

Termination

We may suspend or terminate your access if you breach these Terms. You may cancel your account at any time. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will survive.

Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.

Changes

These Terms may be updated from time to time. Continued use of Bimmy after a change constitutes acceptance of the updated Terms.
